Providence Downs Guide is an independent informational website about the Providence Downs and Providence Downs South communities. The Site is not the official website of, and is not affiliated with, endorsed by, or representing, the Providence Downs HOA, any club or governing body, the community's developer, or any municipal authority. All community names, trademarks, and references belong to their respective owners and are used descriptively.

Informational content, not professional advice

Content on the Site — including community information, buying and selling guides, construction and design commentary, market observations, school notes, and neighborhood comparisons — is provided for general informational purposes only. It is not, and should not be relied upon as, legal, tax, financial, real estate, appraisal, construction, or other professional advice. Indemnification

You agree to defend, indemnify, and hold harmless Providence Downs Guide, its owners, contributors, and service providers from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any law, or your dealings with any third party referenced on the Site.

Assumption of risk & verification duty

You acknowledge that real estate information changes constantly and that we obtain some content from third-party sources we do not control. You assume all risk of relying on Site content and agree that you are solely responsible for independently verifying any fact material to a decision you make, including through licensed professionals and the applicable recorded documents.

Fair Housing & equal opportunity

The Site is published in compliance with the federal Fair Housing Act and the North Carolina Fair Housing Act. We do not make, and do not permit, statements indicating any preference, limitation, or discrimination based on race, color, religion, sex, familial status, national origin, disability, or other protected class. User submissions

The Site provides no contact form, inquiry form, or email sign-up, and we do not solicit user submissions. If you nonetheless send us material by any means, it is provided non-confidentially. You represent that you have the right to send it, and you grant us a non-exclusive, worldwide, royalty-free license to use it for operating and improving the Site. We may remove or decline to publish any submission for any reason.

Copyright complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice through the resources listed on our contact page containing: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material claimed to be infringing and its location on the Site; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. We do not collect email addresses or phone numbers through this Site and do not send marketing messages, newsletters, or automated texts. Any communication you initiate with an independent business linked from this Site is governed by that business's own terms and privacy policy, not ours.

Termination

We may modify, suspend, or discontinue any part of the Site, or restrict your access, at any time and without notice. Sections intended to survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — survive.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully — it affects your legal rights. The parties will first attempt to resolve any dispute informally by contacting one another and negotiating in good faith for at least 30 days. If unresolved, any dispute arising out of or relating to the Site or these Terms shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Union or Mecklenburg County, North Carolina. You and Providence Downs Guide each waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action. Either party may bring an individual claim in small-claims court instead. If the class-action waiver is held unenforceable, this arbitration section is void in its entirety, and exclusive venue for any dispute lies in the state or federal courts located in Mecklenburg County or Union County, North Carolina.

Time limit on claims

To the fullest extent permitted by law, any claim arising out of or relating to the Site must be filed within one (1) year after it arises, or it is permanently barred.

Severability & entire agreement

If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Cookie Policy, and Legal Disclaimer, are the entire agreement between you and us regarding the Site.

Changes

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
